General terms and conditions (GTC)

Scope

These GTC govern the use of the trademark protection service at www.marken-kanzlei.ch, exclusively for Swiss companies and under Swiss law.

Free (free offering)

Scope of services: the free service checks new word mark filings monthly for exact matches.

Availability and liability: the provider may discontinue the free offering at any time without notice. No liability for availability or accuracy; operation on a "best effort" basis.

Changes and termination: the provider reserves the right to change or discontinue the free offering at any time.

Pro and Enterprise (paid offerings)

Scope of services: extended features with professional operation, examining conceptual similarity, combinations of word elements, phonetic similarity and exact match.

Dependencies: service dependent on third-party providers; in the event of outages, the service may be discontinued at any time.

Liability and recommendation: no guarantee can be given. For particularly valuable word marks, consulting a specialised law firm is recommended.

Termination: one-month notice period; immediate termination possible in the event of technical problems. Pro-rata refund of fees paid.

Applicable law and jurisdiction

Swiss law applies; the place of jurisdiction is the provider's registered office.
