The gap in the system: The IPI does not check whether new applications resemble existing trademarks – in November 2025 alone, 16 new word marks were added, none of them compared with "NovaLegal". Whoever files a confusingly similar trademark normally gets it registered – unless the owner of the earlier trademark defends themselves.
The mildest remedy is an opposition before the IPI (official fee CHF 800, three months from publication of the registration). Miss the deadline and only the far more expensive route through the civil courts remains. Early detection therefore directly determines effort and cost.
